  1. PURPOSE AND SCOPE OF APPLICATION These General Conditions govern the access, navigation, and use of the website https://enesztiwebdesign.es (hereinafter, the “Website”), as well as the contracting of web design, online store, copywriting, marketing automation (sales funnel) services, and the acquisition of stationery and artisanal bookbinding products. Accessing or using the Website, as well as filling out the smart quote forms, confers the status of User and implies the unreserved acceptance of each and every one of the clauses detailed herein.

  2. CONTRACTING PROCESS AND QUOTES

  3. Smart Form: The User selects the services, add-ons, or products they desire through the Website forms.

  4. Issuance of Quote: Eneszti Webdesign will send a personalized quote in premium PDF format via email within a maximum period of 48 business hours.

  5. Validity: The quotes issued will be valid for 15 natural days from the date of dispatch.

  6. Perfection of Contract: The contract shall be considered formalized once the Client accepts the quote in writing (via email) and makes the corresponding deposit payment.

  7. PAYMENT AND BILLING CONDITIONS

  • Project-based services (Website, Online Store, Copywriting, Offline Design): A 50% advance deposit is required to reserve the slot and begin work. The remaining 50% shall be paid after final approval of the digital deliverables (files, texts, etc.) and before the delivery of access credentials or final upload.

  • Monthly Content Plans (Blog and Social Media): Payment shall be made monthly in advance at the start of each period. These plans entail a minimum 3-month commitment to ensure indexation and algorithm consistency. Early cancellation exempts the Provider from guaranteeing organic growth results.

  • Artisanal Production: In the event of requesting the physical manufacturing of products (planners, notebooks, letter holders), the production amount shall be paid along with the project milestones. Shipping costs will be calculated separately depending on weight and destination.

  • Billing: In all cases, an official electronic invoice will be issued and sent to the Client by email, valid for tax deduction purposes.

  1. COPYRIGHT AND INTELLECTUAL PROPERTY (RESERVATION OF TITLE)

  2. All intellectual and industrial property rights over the designs, codes, structures, texts (copywriting), blog articles, illustrations, dies, or clichés created by Eszter Novak belong exclusively to the Provider.

  3. Reservation of Title: An absolute reservation of title is established. Ownership and commercial exploitation rights of the delivered services or products shall not be transferred to the Client until the latter has paid 100% of the total amount stipulated on the invoice.

  4. Prohibition of Provisional Copying: The copying, reproduction, manual or digital transcription, screen capture, or use via OCR technologies of technical drafts or texts temporarily hosted on Google Drive for review is strictly prohibited. Unauthorized use prior to final payment shall constitute a direct infringement of copyright and empower the Provider to demand immediate withdrawal under legal measures.

  5. Modification Rounds: Unless specified otherwise in the quote, design and copywriting services include a maximum of 2 rounds of modifications on the initial drafts.

  6. PHYSICAL SHIPPING AND ARTISANAL PRODUCTION

  7. Artisanal production pieces (planners, notebooks, vegan leather letter holders) are manufactured individually and by hand upon demand.

  8. Physical delivery deadlines are estimated and will be indicated in the PDF quote according to the workshop’s workload.

  9. Custom artisanal products manufactured according to the Client’s specifications (including engraved logos or names in gold lettering) are exempt from the right of withdrawal (returns), in accordance with Article 103.c) of Royal Legislative Decree 1/2007.

  10. COMMUNICATION AND TECHNICAL LOGISTICS

  11. Single Channel: To guarantee an efficient, agile, and documented process, all communication shall take place exclusively in writing via email. Unplanned phone or Zoom calls not included in the quote will not be conducted.

  12. Delivery to Print Shop: In offline design services, Eneszti Webdesign will be responsible for transferring the final files (Final Art) directly to the print shop hired by the client and resolving any technical questions with its operators. The Provider is not responsible for printing errors outside its technical control or delays by the external graphic arts company.

  13. APPLICABLE LAW AND JURISDICTION Spanish legislation shall apply to the resolution of all disputes or questions related to this website or the activities carried out therein. For any judicial controversy, the parties expressly submit to the Courts and Tribunals of the city of Torrevieja (Alicante), waiving any other jurisdiction that might correspond to them.
